About the Program

Spain welcomes those who develop business in the country, but  residence permits are not  granted to everyone on this basis. It is not enough to open a company here that will make a profit. Its future contribution to the Spanish economy must be understood and it will be judged by the presented business plan. They evaluate innovativeness, scale of activity - job positions created, potential added value, investment opportunities, as well as the importance of such business for the region.
 
The law does not prescribe the exact amount of investment, the number of created job positions or other parameters of  business that allow it to be considered socially significant. Each case is considered individually! It is important to understand that this path is for those who really intend to do business in Spain. To renew the residence permit, the business plan that you submit upon receipt of the residence permit should be fulfilled.
 
A foreigner outside Spain should  obtain a business visa for a year at first, then enter the country and start to work. If the development of the company corresponds to the declared business plan, the applicant and his family will receive a residence permit for two years, which can then be extended for two years. Residing in Spain for five years is the basis for obtaining a permanent residence permit. And in another five years it will be possible to obtain citizenship by naturalization.
 
The procedure is regulated by the law of 2013 "On the support of entrepreneurs and their internationalization" number 14/2013.

Conditions for obtaining a residence permit based on business

Defence of the business plan

The business plan contains the following information:

- Entrepreneur profile: education, work experience, role in a future project.

- Description of the project: field of activity, date of launch of the project, location, legal form of the enterprise, expected effect from investments, number of new job positions, personnel functionality, innovativeness of activities, marketing and sales strategy.

- Product / service description: detailed, includes innovative aspects.

- Market analysis: assessment and forecast, analysis of potential competitors, consumers, supply and demand.

- Financing: amount of investment, sources of funds and financial plan.

Meeting the requirements by the entrepreneur

- To be over 18 years of age and a citizen of a country outside the EU.

- To have no convictions for crimes under Spanish law in the past five years.

- Not to have violations of the visa regime of Spain and the countries with which it has entered into relevant agreements.

- To have a medical certificate.

- To have sufficient funds to live on at the rate of €2,130 per month per applicant and €532 for each dependent relative.

Please note!

Each project is considered individually. Business innovation is more likely to be approved, but traditional businesses such as retail or hospitality projects may occur to be beneficial for the region.

As a rule, the authorities are more interested in developing business in the provinces, rather than in megapolises. Foreigners who graduated from a Spanish business school, have proven experience in entrepreneurship, as well as proved financial resources for the implementation of the project, will have an advantage.

Residence permit for family members

Together with the investor, the status can be obtained by:

Documents

To justify the issuance of a visa:

  • Business plan
  • Entrepreneur profile (education, experience, degree of participation in the project)
  • Positive opinion of the trade and economic department of the Spanish Embassy in the country of origin or residence of the applicant

For issuing a visa:

  • Visa application
  • The passport
  • 1 photo
  • Insurance policy of a public or private company operating in Spain
  • Certificate of no criminal record
  • Confirmation of sufficient material resources
  • Documents confirming relationship: marriage certificate, birth certificates
  • Receipts for payment of visa fees

To obtain or renew a residence permit:

  • Documents on the establishment and operation of the company
  • Report on the compliance of the company's performance with the original business plan

Rights and Obligations

  • To live in any part of Spain without time limitations. You will need to come to the country at least once under the terms of the extension of the residence permit.
  • To travel within the Schengen area without a visa.
  • To work, including the possibility to work in your own company.
  • To receive medical care with the insurance certificate.
  • To apply for permanent residence permit after five years and for citizenship - after ten years of permanent residence in the country.

The business plan should convince the commission of the viability of your project.

The documents are submitted to the trade and economic department of the embassy or consulate - for those living outside Spain or to the Department of International Trade and Investment - within Spain.

Getting an entrepreneur visa

This step is necessary for those who have not yet moved to Spain. The visa is issued for one year.

The company's performance indicators will become the basis for obtaining a residence permit.

Applying for a residence permit

Applications are submitted to the Large Companies and Strategic Teams Division (UGE-CE). Based on the consideration of the application, you may legally stay in the country

The applicant and his family members should come to the police station in person to receive the cards (tarjeta de residencia).
