The Guide to Real Estate Deals in Croatia

A few years ago foreign individuals couldn’t buy property in Croatia. Since 2014, foreign citizens have been officially allowed to purchase real estate in Croatia with registration as an individual, according to the agreement signed between the countries on the reciprocity of property rights.

To purchase real estate in Croatia, you need to obtain consent from the Croatian Minister of Justice. To do so, the buyer or the lawyer who conducts the transaction submits an application to the following address: Ministarstvo pravosuđa Republike Hrvatske; Uprava za građansko, trgovačko i upravno pravo; Ulica grada Vukovara 49; 10000 Zagreb (Ministry of justice, Office of civil, commercial and administrative law, 49 vukovara Street, 10000 Zagreb).

The following documents must be attached to the application:

  • a legal basis for the purchase (a contract of sale, a gift agreement, etc.) in the original or certified copy;
  • a certificate of ownership of the seller (a document confirming the seller's right to own, namely a certificate of ownership/extract from the land register in the original or in the form of a duly legalized copy, issued no more than 6 months ago);
  • Original certificate (also not older than 6 months) issued by the local administration responsible for urban development confirming that the property is located within the construction zone;
  • A certified copy of the buyer's passport.

The procedure is formal and standardized. If the real estate is purchased by a legal entity, the consent of the Ministry of Justice is not required.

Citizens of the EU countries can purchase real estate in Croatia on the same conditions as the local residents.

Step 1. Reserving the property

Once the buyer has selected the property and agreed on its price with the seller, they can reserve it for further purchase so that no one else can purchase it. The buyer needs to pay a deposit of 3-5% of the property value to the real estate agency. In return, the agency issues a document that confirms the reservation.

The deposit can be returned to the client, or taken into account in the commission of the realtor, or in the cost of the object. Depending on the negotiated individual conditions.

If the buyer refuses the transaction, they will lose the deposit for reserving the real estate.

Step 2. Making a preliminary contract

The conclusion of a preliminary agreement is optional in Croatia. This opportunity is used by those who buy property under construction and have to wait for a certain period of time before making a deal. Also, this path is chosen by those who do not have the full amount of funds to purchase an object.

The preliminary agreement must specify the exact time when the final transaction and settlement will take place, as well as the amount of the advance payment. The latter is negotiated individually. As a rule, it cannot be less than 10% of the property cost. As for the time period when full payment must be made, it usually does not exceed two to three months.

If the buyer rejects the transaction after signing the preliminary agreement, the buyer loses the advance payment. And if the seller refuses, they give the buyer a deposit back in double amounts.

Step 3. Signing a sales contract

By the time the contract of sale is signed, the buyer must issue a TIN with the Croatian tax service. The contract is drawn up by a lawyer and concluded between the seller and the buyer. It must specify the participants of the transaction, the description of the purchased property, the terms, the payment amount and account details, and the presence of encumbrances. For a new property, its warranty period is indicated. Then the contract is notarized.

Step 4. Making a payment

After signing the purchase and sale agreement, which specifies the terms of full payment, there are two options for transferring funds. The buyer can go back to their home country, contact the local bank there and make a payment to the seller's account by submitting the contract.

In addition, it is possible that the buyer first opens an account in a Croatian bank, transfers funds to it from an account in their home country, and then pays for the transaction from a Croatian account.

In either case, proof of origin of funds is not required.

Step 5. Obtaining a purchase permit

The buyer or their lawyer submits documents to the Ministry of Justice after concluding the contract of sale and making the payment. That takes 3-6 months to make a decision.

While waiting for a response from the Ministry, the buyer has the right to live in the purchased property. To do so, the seller and the buyer enter into a preliminary agreement on the right of use and residence, which specifies the respective rights of the parties. Moreover, the buyer can even resell the property during this time, if they receive the necessary power of attorney from the seller.

Step 6. Registering property rights

The procedure is fully handled by a real estate agency or a lawyer, who draws up documents for the new owner. The papers are submitted to the land cadaster, the owner receives the appropriate certificate and pays a tax on the purchase of real estate in the amount of 4% of the value specified in the contract. The tax must be paid within 30 days after receiving the certificate of ownership.

Can I seal the deal remotely?

According to Croatian law, only the seller's signature is notarized on the contract of sale. Therefore, remote purchase of real estate in the country is possible. To do this, the buyer sends a signed contract by mail to the real estate agency, and representatives of the company together with the seller themselves certify the document at a notary.

But by the time the contract is signed, the buyer must come to Croatia to personally issue a TIN with the local tax service, the presence of which is a prerequisite for the transaction.
