French realty market is not very unique in terms of buying procedures. But devil is always in the details. Is there a difference between a purchase made by an individual and a legal entity? Are there any specific rules for building your own house? Can you buy a building with history? What are the pros and cons of real estate on the shore? Read the answers right now.

SCI (Société Civile Immobilière)

In some cases, it is preferable to buy real estate not for an individual, but for a legal entity. For such situations, there is a special type of company called the SCI. By using it, you can significantly expand the capabilities of the owners, namely:

  • Register property for several family members or another group of people. There must be at least two partners, and the composition may change.
  • These can be individuals, including minors, and legal entities, provide them with equal or different shares of ownership, changing them over time. This may be a way to gradually transfer the inheritance.
  • Include one or more items in the property.
  • Determine who will inherit the property in the event of the death of one of the owners. In this way, you can prevent the division of shares.

Optimize taxation, both in the case of inheritance and donation, and in the current management of real estate.
Such a company is usually registered by a notary between the signing of the preliminary contract and the main sales contract.

Commercial Real Estate

Foreign individuals and legal entities have the right to buy commercial real estate in France. First of all, hotels are popular among investors, but there is also a demand for restaurants, shops and office spaces.

A transaction on the commercial real estat market is concluded according to the regular rules, with the mandatory participation of a notary.

In contrast to the purchase of residential property, the development of a company gives the right to a residence permit. If the amount of investment exceeds €30,000, and the business plan seems promising to the immigration service, a foreigner can move to France under the "passport-talent" program.

Properties of Special Historic Value

This type of real estate includes, for example, medieval castles. Their number in France is large, and it is possible to make such a purchase, if you have the appropriate funds.

However, the ownership of such an object imposes special obligations on the owner:

  • In architectural monuments, all repairs must be approved by the Ministry of Culture (Service Regional du Patrimoine et Monuments Historiques). Restoration can be carried out by architectural firms that have a license in France and experience in such projects.
  • The owner must inform the state about the acts of purchase, donation or inheritance.
  • In some cases, it is mandatory to open a historical monument to the public.

Housing Under Construction

The state strictly controls the activities of the developer and guarantees the buyer's safety. However, the main contract of sale cannot be signed until the basement is built. The document specifies the cost, exact description of the property, its area (possible error of 5%).

The reservation fee when buying a home from the developer can not exceed 5% of the price of the property. The payment schedule is approximately as follows:

  • 35% – after the basement is built, at this stage, the transaction is notarized;
  • 35% – after completion of roof works;
  • 25% – upon completion of interior works;
  • 5% – key passing.

After completion of construction the buyer receives a dossier confirming this, certificates of compliance, a certificate issued by the city hall, and other documents.

When the project is put into operation, various guarantees of the developer come into force:

  1. Guarantee of high-quality completion of construction, valid for a year after the delivery of the project, obliges the developer to correct all construction defects.
  2. Ten-year warranty on the strength of the building. It is used by the developer to repair major damage to the basement, walls, roof and supporting structures.
  3. A two-year warranty is provided for electrical, fire and lighting equipment, plumbing, elevators, suspended ceilings, etc.
  4. Warranty for repair of damage. Refers to various types of damage, the damage is determined by the court. For example, the dismantling and replacement of elements of heating equipment.

Land Plot for Construction

A lot of land on the coast and in the mountains of France is not subject to development, so before buying you need to clarify whether it is possible to build on a certain site. Also, the seller of real estate is required to provide information about soil contamination due to industrial emissions.

If the site is located on a riverbank or in the mountains, you can request information from the mayor's office or prefecture about the possibility of flooding or avalanches. In addition, when buying such land, you should keep in mind that you will have to free up a public passage along the water's edge or a passage for skiers.

Since the state has the right of pre-emptive purchase of land, it is recommended to send a request to the mayor's office, whether the site is reserved for state purposes.

If you purchase land within 500 m of the historical monument, you will need to obtain a construction permit from the authorities.

The construction permit is provided by two certificates. The first one (Le certificat d'urbanisme ordinaire ou simplifié) specifies the possible size of the building and the construction zone, but does not itself give the right to build. This right is granted by the second certificate (Le certificat pré-opérationnel ou détaillé). To get it, you need to add a document to the request that describes the proposed work.

Pay attention to circumstances that can dramatically increase the cost of construction. First, whether the necessary communications are connected to the site: electricity, water, gas, telephone, Internet. Otherwise, you will have to do it. Second, you can request this information from the mayor's office if the boundaries of the land plot are set accurately. If necessary, you will have to carry out additional delineation of the area with the involvement of a surveyor. You should also pay attention to the terrain. Construction on a sloping site will cost more.

Real Estate on the Coastline

Ownership of real estate on the coast imposes certain obligations on the owner:

  • The distance from buildings to the lower tide line must be 100 m minimum.
  • The urban plan limits the type and height of buildings and fences, as well as the use of building materials.
