The Spanish government starts to radically control rents as part of its first-ever national law "On the right to housing."
What happened. The new law Ley por el Derecho a Vivienda ("Law on the Right to Housing") will allow the regional authorities to set the maximum price on rent for the homeowners who have more than 10 property units. The rules will affect areas that are considered "stressed markets."
The law also includes tax penalties for owners who do not rent several apartments for a long time. Also, the state will reserve 30% of apartments in new buildings for low-income families.
Context. The new law, first approved as a draft in October last year, was adopted by the Legislative Assembly on February 1, 2022. It is a part of the ongoing efforts of the Spanish government to overcome the acute housing affordability crisis, as a result of which tenants have faced price increases of 50% over the past five years. Even despite a slight slowdown last year. And, according to experts, without additional control, rental prices can generally skyrocket.
The rental market. The housing affordability crisis in Spain is caused by low supply, which does not keep pace with demand. The Spanish government has historically encouraged homeownership. As a result, approximately 75% of local households own their own homes. Consequently, Spain has one of the smallest rental markets in Western Europe.
In Barcelona and Madrid, locals have to compete with tourists for rent, as more and more apartments are rented for a short time. Meanwhile, the construction of new rental houses slowed down after the housing bubble burst in 2008. As a result, more than half of people aged 25-29 still have to live with their parents.
Nuances. The new rules have already attracted criticism from the construction sector. International investors from Spanish real estate companies warn that the innovations will hinder further investment in the Spanish real estate industry and development.
