Buying Property in Mexiso in 4 Steps

Mexico is a hot market due to low prices, great climate and relatively good standard of living for expats. But what should you expect before becoming a property owner? It is difficult to buy real estate in this Country? Let us guide you in the process.

Step 1. Reserving the property

After choosing the property, you make a written offer to a seller with the help of your broker and pay a deposit of 5-10% of the property value. 

You can make a deposit in cash, by bank transfer or by cheque. It serves as a guarantee of the transaction. Your real estate agency keep it until the signing of the ownership document (escritura).

If the seller refuses to conduct the transaction for some reason, the deposit is returned to the buyer in full. If the transaction did not occur due to the buyer's fault, the seller keeps the deposit. 

The offer does not require notarization, but can be signed, scanned and sent to both parties by email. The offer specifies the terms of the transaction: the cost of the property, the form and terms of payment, the amount and form of payment of the deposit, as well as penalties if one of the parties does not meet the conditions.

Both signing and deposit secure the property to the buyer and allows you to start preparation of the transfer of ownership rights.

Step 2. Signing of the document on the right of ownership

The mandatory stage of the transaction is the signing of the title deed (escritura) in the office of a Mexican notary.

A notary in Mexico (notario publico) registers any real estate transactions and also is responsible for the legality of the transaction. This is an experienced specialist with a legal education, appointed to their position by the state government. You can become a notary only after you have acquired sufficient experience, successfully passed a special exam, and if you meet all the requirements set by the government. After signing the transfer of ownership in the notary office, the notary registers the object in the state registration chamber (registro publico).

But the contract of sale (contrato de promesa de compraventa) is not a binding document, if the terms of the transaction are specified in detail in the offer. This is a bilateral agreement that does not need to be registered with a notary. The document can be signed in a notary office at the request of the parties.

The contract of sale is always drawn up in Spanish, can be signed remotely and sent by email. Both parties can also sign it in person in the presence of a notary. The document specifies the full cost of the property and the payment method.

After that, the buyer makes a bank trust (fideicomiso). To do this, you must present your passport, immigration card, and Mexican taxpayer identification number (RFC)  and resident registration number (CURP).

The cost of opening a trust is $800-900. The annual service fee is $500.

Step 3. Making a payment

After making a trust fund, you transfer the rest 90-95% from the agreed amount of money to the account of the real estate agency. Optionally you or the seller can make an escrow account, which allows to put money there (just like on your personal account), but later the money will be redistributed among the parties after the final settlement at the notary’s.

Step 4. Registering of ownership

The total duration from the moment of making an offer to signing the escritura depends on how long the bank takes to open an account. This usually takes 45-90 days. After that the contract for ownership is registered in the registry publico.

Can I seal the deal remotely? 

If you cannot or do not want to attend the final deal personally, you can make a power of attorney for your legal representative. This can be your agent or a lawyer. 

If you visit Mexico to choose the property, then you can make it at the notary there. If not, then you can issue a power of attorney in your country, but don’t forget to translate and apostille it.
