In these circumstances, the President resorted to prohibitive measures and signed the Executive Order suspending the issuance of a number of work visas until the end of 2020. The main types of visas have fallen within the scope: H1B - for highly qualified specialists, H-2B - for seasonal workers, and others. However, other types of visas are still issued, and each case is considered separately.

Before the crisis, American job sites were filled with vacancies in the service and physical labor sectors. In construction professions alone, 40,000-60,000 vacancies appeared per day.   • A student (to find a job, they need to get a permit from the university or college).
  • The bride or the groom of a US citizen must have a K1 visa and a social security card for 3 months. During this time, you need to legalize the relationship and apply for a Green Card.

The main requirements are compliance with the “Immigration and Nationality Act” and certification. The Ministry of Labor must be sure that you are needed for the country and will not deprive a local citizen of work by your arrival.

  • H-1B

The most popular type of work visa. Issued to experienced and highly qualified specialists.   • H-2B

Issued for a year, but can be extended up to 3 years. The country has an annual quota of 66,000 for this type of visa. Getting a Green Card is not provided.

  • H-3

  • L-1

It is issued to managers and especially valuable specialists of a specific company registered in the United States. Depending on the position, it is issued for 3-7 years. The main requirement is official work in the organization for at least 12 months in the past three years.

And this is not all categories of work visas. There are also specialized: H-1C (for nurses), O-1 (for talented foreigners), Q-1 (cultural exchange), etc.

It is ideal to enter the country with a Green Card, but not everyone can do it.

The process of obtaining a work visa

Before submitting documents, you must find an employer and prepare a package of documents for the American Consulate:

  • invitation letter from a company in the United States (it can be either an individual or a legal entity);
  • DS-160 application form (to be filled out on the Consulate's website);
  • before submitting the application, you need to pay a $190 visa fee and make an appointment for an interview, without successful completion of which it is impossible to obtain a work visa. For the interview, you need to take all the specified documents (diploma and employment – originals), an invitation to an interview and confirmation of application. Questions can be both personal and professional.
  • ETA-9035 application form is filled out by the employer and sent to the Ministry of labor before you submit your documents;
  • employer's permission confirming that they can hire a foreigner;
  • a certificate from the employer indicating the position and average salary;
  • a copy of the diploma and employment record;
  • a license to carry out specific activities (if necessary);
  • documents demonstrating the level of qualification (diplomas, certificates, etc.);
  • confirmation of the availability of property (apartment, car, money in the Bank account, business, etc.);
  • personal documents: foreign and national passports, a marriage certificate, photos.

The application must be submitted 3 months before the scheduled date of employment, and you must enter no later than 10 days before the start of the contract. Prepare your documents carefully and do not try to falsify them: if the truth is revealed, you may be banned from entering the country. If application is successful, your family members can also come and live in the United States, but without the right to work (H4 visa).

Work permit

If you immigrate to the United States, this does not mean that you automatically have the right to work. The permit allows you to work in the country and gives the employer the right not to coordinate your admission to their company with the authorities. The following types of temporary residents in America are required to obtain a work permit:

  • family members of refugees;
  • students with an F-1 visa
  • graduates who want to complete an internship after training;
  • employees of a foreign employer (provided that they themselves have been working in the country for at least a year);
  • family members of an immigrant with a work visa;
  • visitors who have applied for a Green Card;
  • foreigners who came to America at the request of the authorities.

Refugees do not need a work permit – when they enter the United States, they receive an I-94 form, which they then show to their employer.

To get a work permit, in addition to a special application, you must submit a list of documents to the Citizenship and Immigration Service (USCIS), the specific list of which is determined by the category of immigrants. All papers must be in English, and a translator's certificate must be attached. After that, the service sends an email with the date when you must report to the local office to collect biometric data.

About illegal employment in the United States

Getting a work visa is not an easy process, but illegal activities in America are much more problematic. Recently, measures have been tightened due to the influx of illegal migrants, the financial crisis and in order to improve security.

Periodically, the authorities conduct amnesties, after which illegal immigrants can get temporary registered status for 6 years with a fine of $500. But hoping for such indulgences is not worth it.

Keep in mind that even if your visa is expired by a day, you will be deported. If you have been living in the country illegally for 6 months, you are not allowed to enter America for the next 3 years, if a year or more - for 10 years. Moreover, the penalty is imposed on both sides: the employer not only pays the fine, but also is subject to criminal liability in particularly difficult cases.
